How to prevent being scammed by a real-estate developer, broker, agent

Due to our exposé regarding the flooding at Lancaster Estates which can be seen at this webpage, a lot of people have been sending us the same emails requesting us tips on how not to get scammed by real estate developers, its brokers and their agents. We are no expert regarding the scams they make but we can however help our readers by listing up some of our experiences with our village's real-estate developer, Pro-Friends, and how it could have saved us from never-ending headaches if we only knew what was about to befall us before we have signed that cursed Contract-to-sell. Please read more.



1. Check with HLURB if the exact phase and real-estate project you are interested in has a License to Sell. It is important that the license-to-sell must exactly match the phase. For example: Lancaster Estates' billboard ads shows that their LTS number is 22955 and they are using that for the whole Lancaster New City Cavite projects which includes over 40 phases. But if you research on that LTS number, it only specifies a License to Sell for just one phase which is just Lancaster Residences phase 6. While the ad shows Alexandra houses available on their Manchester projects but LR6 only has Manor houses. To search for the LTS number, you may use HLURB Online Services in this link.

If phases are not issued a License to Sell by HLURB, that means that the developer has not complied to numerous requirements which includes suitability of the area for housing and more. You may also have problems on obtaining your Deed of Sale for your property because if the developer does not have a license to sell, then how would there be any selling of property to get a deed of sale?

As of the time this article was written, only one (SS1) has been issued with a License To Sell while the other phases do not have any on Lancaster New City Cavite  at Navarro, General Trias (Manchester, Somerset, Kensington).

In Lancaster Estates Alapan, Imus: LV2-East and LV2-West does not have a License to Sell.

The License to Sell advertised for Lancaster's 59 phases is only for Lancaster Residences 6

ProFriends according to the law is liable for a fine and full refund.


2.  Check with what your developer is giving you on their Contract-To-Sell. If it has anything that tells you that you are automatically a member of the homeowners association even though the phase where your house is located is still under development, it may be possible that your developer may have done some "magic" to legalize the HOA eventhough there are still no homeowners on-board. A developer holding a HOA is illegal under the law and it is prone for corruption if your developer handles the homeowners association. See our own experience here.



3. Do not get fooled by model houses or sweet talk by your agent. Regarding your house's integrity, and the land where your house is going to be built, make sure to do a thorough research about it. For a reference on your research, ensure that the houses and the land at least complies with the National Building Code and Business Standards and United Nation's Guide for House contruction in the Philippines.

In Lancaster New City Cavite / Lancaster Estates, we have seen a lot of things that do not comply with the above mentioned references.

4. Check Nababaha.com if the property you are planning to buy lies within a flood hazard zone. They provide a very precise flood map. Too precise that it never got wrong for us when we got flooded. See our article for 2013 here and 2012 here.

5. Amenities that the developer is promising must be in the contract. If not there, it is safe to assume that they can go unscathed of legal obligations if they choose not to fulfill their promise. Or worse, they would say that the HOA dues are needed to start its construction. Do know that an amenity is supposed to be free as it is already part of the premium when you bought a house from a developed project. But in Lancaster Estates, they have even tried to collect fees from it.

6. Make sure that they don't have any policy of prohibiting you to inspect your unit while under construction. This will make you blind and you are left to only inspect and accept your unit when the internal deficiencies have already been covered up. After one of Pro-Friends project, Montefaro, was exposed in GMA News' Imbestigador (video), they started to be stricter in Lancaster New City Cavite / Lancaster Estates by prohibiting unit owners to inspect their units while under construction and you are only allowed to inspect your unit twice. First is right after it is completed and second is if you have any issues in the first inspection that you want to be fixed. And if you failed to include some issues in the first inspection that you just discovered in the second inspection, that will no longer count.

7. Try to check if there are construction lapses in comparison with the blueprint. This site is an example that exposed some of the construction lapses of Pro-Friends on Lancaster Estates (link).

    Yesterday, October 3, there's this unit - thankfully, no resident yet...
    there's a large part of the ceiling of the ground floor- (so its the 2ndfloor's floor.. ) COLLAPSED! funny? scary? ill try to get the photos..

Hi po, isa rin po ako sa nakakuha ng unit dito Kensington Phase 3 Block 1 Lot 52 ito ang location na ibinigay saakin , ang problema ni hindi ko pa nakita o nainspect man lang ang unit at ang nakakaloko pa is 2 months na ako nagbabayad sa bangko na ng approved sa loan ko , I don't know what to do wala ako magawa kasi wala ako dyan sa Pinas.

    5. Hi anonymous, under bank process na yun loan ko.. OFW din ako but ang AIF ko ang nag check sa unit ko sa KS03, I think magkalapit lang tayo.. okay naman na yun unit ko kase nag transfer ako ng unit dati sa KS16 ako at 0% construction pa dati.. kailangan mo makita yun kase di naman ma approved ng bank yun kung di pa nakatayo..

    1. KS22 is virtually still a farm. If you want to check if it is flood prone. You may check the Flood Hazard Map above. KS22 is at north of the photo which lies at the edge of the red zone (high flood hazard) and orange zone (moderate flood hazard)

    5. Puro paninira naman ito. Bakit di nyo naman tanungin ang mga homeowners na satisfied at masaya sa nabili nila sa Lancaster. Madaming buyers na magaganda ang napiling unit and location pero dahil sa blog na ito nagbabackout tuloy. Sayang yun chance. Puro hinanakit ang nagsulat nito kaya gusto mandamay at maghanap ng kakampi. At hindi po scammer ang developer, brokers at agents ng lancaster. Sobra ka makapanirang puri ang loser na writer ng blog na ito. Grabe!

    6. I find this article very objective and backed up by facts. But I am the type of person that wants to see things first-hand before believing. I went to LNC this afternoon, knocked on some homeowner's house and was happy for some of them allowed me in to check it. I also verified and backtracked the documents shown in this blog. This blog seems to tell facts. Thank you, and this article saved me a lot from headaches and ended up looking at a project by another real-estate developer other than ProFriends.

  5. Your blog is very helpful and i want to thank you. now, i have already started paying my D/P fo about 6 months for a H&L at Manchester Village. I want to back out but Profriends says there's no way i can refund the money already paid to them. Can you please suggest what to do and who can help me refund my money? thanks again.

    1. Manchester? The first comment made by me in this blog post may help you. It is a 100% refund according to HLURB. If they won't give you a refund, you can sue them big time.

Punta po kayo sa Profriends Problems Page pa member po kayo doon para matulungan din namin kayo doon, mahigt 100 members na namin ang nakakuha ng Full at partial refunds and the fight still continue with Batch 5, makaka refund kayo kapag alam ninyo ang tamang proseso, at huwag kayong matakot sa Profriends, Batas ang pinanghahawakan natin.

  6. Nakabili din kami isa sa bahay sa lancaster, nka 11 months hulog na din kami.. kaso noong pinafollow op nmin sa agents ang status ng bahay...nagtuturuan na cla at ala daw alam .kaya nagdecides na kami di na hulugan kaso di na rin nmin makuha hinulog nmin kac daw no refund daw:-(

I know the feeling gaya mo malas din kami sa nakuha naming ahente, nakakainis man pero tinuloy pa rin naming ang bahay kahit ang dami naming nababasang negative tungkol sa Lancaster pero nag aalala kami na baka masayang ang pera naming nahulog na w/c is nasa 13 months na dahil sa alam naming na wala ngang refund base sa contract na pinirmahan namin pero thankful na lang din kami dahil may kaopismate pala din ako nakakuha na rin dito at nakaturn over na sa Diana na nakuha nya. she helped me na magprocess sa mandaluyong where is the head office of Profriends. i can say ay ok nman pala dito sa Lancaster we are currently residing now for almost 8 months na and looking forward to experience our Christmas and new year in this village by the way ks2 resident ako and mababait din naman ang mga kapitbahay ko. siguro observe nyo na lang muna ang place before kayo maniwala sa lahat ng blogs also about sa baha issue nakausap ko ang mga kapitbahay ko na nauna ng residente sa lugar like Judith ang sabi nya that was aug habagat yun ang reason daw is nakabakod na ng ks2, so wala man lang nadadaanan ung tubig ulan, kaya naipon sa loob ang tubig na galling sa gate mismo, kaya ginawa nilang magkakapitbahay and her hubby tulong tulong sila giniba ang pader then nagdatingan na mga security guards sinira nila ang dulong yero na makikita nyo pagpumasok kayo ng ks2, noong natibag ang pader at may nadaanan na palabas ang tubig ulan mabilis naman nagsubside ang tubig bahay. isa pa about sa quality ng bahay namin even townhouse eto matibay nman ang gawa contrary sa sinasabi ng iba na di nman residente ng lugar

    2. Security issue ang pagtibag ng pader. At dahil kailangan pa sirain ang pader para umagos ang tubig, ebidensya na pangit ang drainage. Ireklamo niyo yan sa PFI para palitan. Ang KS2 pa naman high flood hazard sabi ng mga eksperto sa UP.
      Masmaganda din ang townhouse kaysa sa single-detached kapag pinaguusapan ay katatagan ng bahay sa Lancaster. Imagine mo walang biga at poste. At least, may sasalo na bahay na katabi at kadikit mo kapag lumindol at tumagilid. Yung mga Alexandra, Gabrielle, Sophie, etc, delikado. Ingat lang po kayo jan. Mas importante ang buhay ng pamilya niyo kaysa sa bahay niyo.

  7. Hello all, I just checked with HLURB, wala raw certificate of registration and license to sell yong Manchester ph 11and I just started paying my D/P for a H&L unit there. I hope somebody will initiate a class action suit against Profriends for violation under PD 957, Buyers Protection Act. Wala lang ako diyan sa Pinas and i can't do anything
    but meantime stop payment. Please bring your concern to HLURB and everything and everybody will follow suit.

    1. same here.. paid reservation amounting to 10k for a sophie model for that time may promo silang 50% discount. i already told my agent that we will not pursue with buying due to the numerous number of complaints and blogs we saw in the internet. can we ask for a refund? 10k is also from our blood and sweat. we were given SS10 block8

  9. The structural integrity of those houses will be put to test soon as earthquake of a magnitude of 7.20 has strike Visayas just this morning. In my opinion, somehow that earthquake has affected the faultline in Luzon and will likely trigger a earthquake.

  10. Hi, thank you for this post. I first saw about the advertisement of Lancaster in FB and I admired how it is being pushed. I am an agent of another subdivision and a prospective buyer later told me that she was about to buy a property in Lancaster when she read online that there are a lot of complaints. I was overwhelmed with the issues of this developer and still, they have the audacity for such ads. I'll ask your persmission to use this article as one of the references of those going in our page.   11. As shown by this blog that Lancaster Estate is not truly flood proof. The Next question is, with the 7.20 magnitude earthquake that hit the Visayas region recently, will Lancaster Estate be earthquake proof on a 7.20 magnitude? Of course as usual, the developer and its agents will say as what they have said before LE was flooded that it is "flood and earthquake proof". Time will tell, and if they are not as they say they are, lot of lives will be lost in a unsuspecting neighbourhood. Imagine, when an earthquake strikes during night time when all family members are sleeping, and all four corner walls and the second floor slab will just collapse on the ground because they are not built as they are supposed to be.

  12. ATTENTION: For those wanting for refund, seek the help of HLURB. File a complaint. The more complainants will file refunds, the bigger the chance that HLURB will take notice and will take action against Profriends and their policy of no refund will be over ruled. It's illegal.Their applications for Certificate of Registration and License to Sell will not be approved or maybe revoked until they comply. We are protected under PD 957, the Buyers Protection Act. Please do it now. If not now, when? If not you, who? Good luck!!!

    4. good day! same concern here guys... me and my partner are done already with our downpayment. we were advised that after 15 months, we can move in. however, they informed us again that it will be finished after a year. we are also seeking for a full refund... are we still eligible for this?

    7. Guys if you seek for proper process of getting a refund and filing your complaints magpa member kayo sa Profriends Problems page and it is there that we can guide you through. After making the demand letter and PFI always give the generic reply of sorry blah blah blah and doing it 3x then proceed to filing the complaint at HLURB, filing fee depends on the amount of claim say for evry 100,000 is equivalent to 1,000 pesos filing fee, no attorney fee shall be paid, coz you will first enter into a mediation for at least 3 hearings.

Sa tingin ko, di naman sinisira ng blog na ito ang Lancaster na tinitirhan niyo, bagkus sinasabi nito ang maaaring kinakaharap niyo dahil sa kalidad ng bahay at lugar na binili niyo dahil naloko kayo ng profriends. Kung meron man dapat kayong sisihin, ayung ay ang developer at mga ahente na nanloko sa inyo. Wala naman akong nakikitang panloloko sa nakasulat dito kung puro detalye na may ebidensya. Kasi kung walang ebidensya, ayun ang panloloko.
      Salamat at may blog na ganito na nagbukas sa mga isip namin upang alam namin ang kailangan paghandaan. Salamat at may blog na ganito na maaasahan.

Yung mga nagsasabing hindi totoo, wala naman mapakitang ebidensya, samantala itong blog na ito at iba pa bukod dito, kumpleto sa reference at picture at ebidensya. Profriends ang may pakana ng lahat ng mga tumutuligsa sa blog na ito eh wala naman akong makitang mali sa nakalagay dito.

    5. Kung may sumisira man sa lugar kung saan ka nakatira, ayun ay ang lagay at kalidad ng bahay niyo. parepareho kayong may mga bahay na walang biga at poste and substandard na precast. Hwag mo isisi sa blog na ito ang problemang dulot ng developer niyo. pasalamat pa ako at may ganitong blog para warning-an kami sa kundisyon ng kinatitirikan ng bahay jan. baka nabola rin kami tulad ninyo kung wala ang nagmalasakit na grupo para isulat ang blog na ito.
      kung masaya ka, eh di maganda. at least di niyo nararamdaman na biktima kayo "sa ngayon" pero mas masaya kami at di namin natuloy ang pagbili ng investment sa lugar na yan.

  23. Ks7 alice. Do u guys have an idea if this has been given an LTS? I finished paying my dp last june and a call fr lancaster told me to stop paying and resume when i already have the house. Am contemplating on getting a refund and will seek a lawyer's advice if PF will give me a hard getting a refund. Pd ba yun na d na daw muna ako maghulog? At given all these info im getting fr the internet it makes me so worried.
    I was promised I'll have my unit 3 mos after completing my downpayment but when i called pf last year june of 2014 pa daw. This is not fulfilling what they promised their costumers, right?

    Last year (2013) when i was about to make a decision for myself of investing a house and lot, i was considering Lancaster (Profirends) by then.

    My demand for a House and Lot is going a lil bit of a priority due to some inconsistencies I encountered renting at the metro.

    I was constantly praying to God that He may guide me to all of my decisions whatsoever in my everyday life.

    I don't know kung bakit hindi ako natuloy tuloy sa free tripping jan sa Lancaster. Kahit I excerted a lot of effort na to contact a certain agent there, nakapag set na ng time and place for meeting but still hindi ako natuloy tuloy and I dont know why, laging may mas urgent akong pinupuntahan.

    Untill then, may isa akong officemate na nakatira na sa isang subdivision sa Rodriguez, Rizal, he took me into tripping and guess what, no one bothered me at that time, natuloy ang tripping namin, and na inlove ako sa lugar, after a week or 2, i visited again just to familiarize myself with the love i felt during my first visit.

    hayun, gusto ko talaga yung lugar, dun na din ako kumuha.

    Then, eto pa, i recently learned that my ex also bought a unit there and to my surprise, magkalapit lang kami ng unit. haha

    Extra care and extensive research for investing ay kailangan talaga espacially if involve ang money. Jan dapat tayo nag iingat ng bongga.

Hi Renn, yung 20k ba ay reservation fee? if reservation fee un, mejo malabo siyang marefund lalo nat wala pang LTS. pag ala kasing LTS, hindi ka makakademand ng full refund ng dinown mo. antayin niyong magka LTS un tsaka kayo magdemand ng full refund, delayed turn over ay enough ground na for full refund. =)

After they have received my email, someone called me asking for a meeting with executives and I said no because they will make bola lang and by saying yes to their request then you are just giving them a chance to fool you more. Said NO and tell them that you will not stop until you get your money back, and that you will go to all the media that you know and that you will go to a certain Congressman....you can use names of politician and you know what that is how I got my money back....in FULL!!! At para magkaroon tayo ng legal actions, legal documents para may bala tayo vs pro friends. Kasi kung si Pro Friends parin ang kaharap natin, for sure walang refund ang mangyayari. Advise ko lang, wag kayo magpauto na meron silang ready for occupancy units for transfer sa original units (location na kinuha nyo) for sure, may hidden dahilan yun at for sure, mas masalimuot lalo. Sa mga nakakabasa nito, please mag post kayo nga numbers or meron tayong general FB page para dun natin mabasa ang announcements at updates para sabay sabay tayo magreklamo or kung saan man tayo pwede sumangguni sa kinaukan... - Jun

  54. My wife and I went for tripping today Tuesday 7/29. Our PF agents were very nice and answered all our questions. We were very interested in the Gabrielle and a unit in MS9 was held for us. My wife was ready to sign and pay the reservation fee but I was able to convince her that we need to discuss it overnight. I saw this blog and all the comments from you guys. I just want to thank you for saving us not just the money for the reservation and possible down payment/s, but for saving us the hassle of having to chase PF for a possible refund. Now we're ready to look elsewhere.

  56. I also found out last Wednesday, August 13, na hindi pa gawa bahay namin. The fact that the company assured us that after completing our equity we will be having our home. Eh hanggang ngayon wala pa rin tapos "stop payment" muna kami. Also, bakit ayaw nila sa Pag-Ibig Fund? Wala rin update sa bank or whatever. Bought unit from KS-27 also and I'm considering a refund.

  57. i thought it was pro-friends eh pro enemy ngyayari, had the same problem, tapos ko ng bayaran ung dp last 2013 pa & mang one year na until now, di pa rim kami maka move in na for approval pa daw ng bank etc.dami nilang excuses. i thought 3-4months lang at makaka move in na, gusto ko na rin kasi maayos ung monthly amortization kpag naka move in na kami, if di pa ako mag follow up last June 2014, di ko malalaman status, wala nman pala sila ginagawa eh... taung mga client nag naiipit sa sitwasyon/.

  58. pag kukuha ng bahay siguraduhin kasi na kaya nyo iprocess ang lahat ng docs needed. andami nyo problema kami naman kahit konti wala naging problema. nakalipat kami ng walang kaba dahil bago pa kami kumuha ready na kami sa mga requirements at docs.. mga no read no write ba kayo para magka problema sa BASIC DOCUMENTS needed?

    1. Tama. Pag-aralan mabuti ang dokumento at kontrata. Kasi di mo alam, death warrant mo na pala pinipirmahan mo. Yung lang, akala nito tao sa taas naka-isa na sya at wala siya problema sa dokumento. Oo nakuha mo nga bahay mo. Substandard naman. Paglumindol, crack kaagad yan baka gumuho pa kasi walang poste.

  63. ano ba to? kakavisit ko palang sa lugar ng lancaster sa kensington at balak ng kumuha ng diana, kaso nung nabasa ko to bigla naman akong nagdalawang isip. sana me mga comments pa sa mga nakatira na dito at mapatunayan kung ano ba talga at worth it bang bumili at maginvest sa lugar na to. dami kasing bad feedback hirap din magsisi sa huli at di pa nmn refundable ang maihuhulog mo. ngayon maganda sana ang deal at 9 mos lng pde ng turn over at mura lng din monthly. napapaisip tuloy ako.. salamat po sa makakasagot.

    I have a few questions po and I would really appreciate it if my mind can now finally be put to rest. Hehe.

    My parents were planning to get a house of their own and for us to finally stop renting. They have already paid the equity in full tapos po inaantay nalang yung approval po ng banko for loan. Hindi po na approve. So they made it into an in-house so mas naging mabigat yung mggng payments per month compared sa pag sa bank kami. In the long run, hindi na nakayanan bayaran po. Is it possible for them to get a full (or even partial) refund if:

    1) Matagal na po since my parents last had contact with profriends, and I've read din po sa post nyo dito na within 60 days lang pala ang deadline for buyers if they aren't able to pay na. Ang ginawa po kasi ng parents ko they just let it go nalang po. Kasi ang sabi sakanila no refund daw po. So is it still possible pa po?

  71. I bought my house year 2012 and already paid my downpayment, but they never turnover my house on year 2014. I kept asking for the status last year but never got their feedback and if I can check my house since PNB was pushing me to sign the LOG. Last January 2015 with the help of my agent, I was able to visit the house, but was never allowed inspect. I just stayed in their car as I am also not allowed to go down since LOG wasn’t signed yet. They need the signed LOG first before they allow me to inspect. But due to issues, complaints and scandals I’ve read and heard about the developer, I chose not to sign and prolong it as I am not only talking about thousands of pesos here. My agent also advised me to prolong it since its their fault of not turning it over to me after paying the downpayment.


    This April 2015, I asked for cancellation of the house, but request was declined after 2 months of waiting for their feedback. Just this June 15, they told me that they will cancel my account for not following their option of selling it to my friends or family members. I asked them about the process of transfer of ownership, etc., and they replied. But sadly, they already cancelled the account and the house is on the market for sale. They said that I failed to acknowledge their email and they need words (as in literal na words) from me that I accept their options. LOGICALLY speaking, the fact that I sent and asked for the process, it means that I am still willing to sell it. But too late and they said that I need to submit a reconsideration letter, but this would require approval and they will also look for NEW UNIT for me.

Sabi nung una after mabayaran ung downpayment move-in na daw.sabi ko ipapahold ko yung mga tseke lasi dapat magstart ako ng monthly amortization pag nakamove-in nako at approved na ng bank yung loan.sabi ng agent pwede daw yun.so kampante ako.nung malapit na magdue yung post-dated check ayun sabi ng agent kelangan na daw magsimula magbayad,nagkalokohan in short.at hindi rin natapos yung bahay kahit lampas 24 months na.masakit sa ulo si profriends.nagkamali ako.������
